This allows a judgment creditor to recover outstanding debts by directly freezing and obtaining funds from the debtor’s bank account.
Writ of Seizure and Sale (seizing debtor’s assets)
If the debtor fails to pay, this legal action enables creditors to seize and auction the debtor’s movable or immovable assets (such as vehicles, machinery, or property) to recover the outstanding amount.
Judgment Debtor Summons (compelling payment)
A Judgment Debtor Summons (JDS) compels the debtor to appear in court and disclose their financial status. If they fail to comply or refuse to settle the debt, the court may take further action, including ordering installment payments or issuing a committal order.
Bankruptcy Proceedings – If the debtor is an individual and owes RM100,000 or more, the creditor can initiate bankruptcy proceedings to seize and liquidate their assets for debt repayment.
Winding-Up Proceedings – If the debtor is a company, a winding-up petition can be filed to legally force the company into liquidation, allowing creditors to recover debts from its remaining assets.
